As required by EU Regulation 679/2016, SERVITECNO Srl informs you that it applies the provisions of the laws on privacy, also with reference to the security measures and protection of personal data. The data processing that you intend to carry out will therefore be based on lawfulness and correctness, in full protection of your rights and in particular of your rights to privacy.
1. Purposes and methods of treatment Therefore, pursuant to Art. 13 of the aforementioned law, we inform you that the data you provide us on the occasion of the service you request will be used for the following purposes:
- Management of the existing contract (purchase and sale of industrial automation software, maintenance management systems, cyber security tools, ...)
- Fulfillment of accounting and tax obligations
- Commercial, promotional and marketing purposes for sending technical, commercial and promotional material of the products and services offered by the Undersigned.
The envisaged treatment will be carried out in the following ways:
use of paper and/or electronic media, also according to technological evolution. SERVITECNO's information system is on a protected network and is not accessible from the outside. SERVITECNO's collaborators, whether they are employees or collaborators, called to carry out the activities related to the performance of the requested services, have been formally appointed and have received adequate training. Their names will be communicated, if requested, promptly and contextually with the evolution of the activity itself.
The paper documents collected are kept in closed, guarded and supervised archives to which access is prevented to those who have not been appointed. The SERVITECNO environments are manned and subjected to permanent surveillance with anti-intrusion services.
2. Nature of the provision and refusal The provision of data is necessary for the personal data that can be used for the execution of the contract according to the purposes specified above and precisely: performance of the requested service, legal obligations and in compliance with administrative and fiscal obligations.
On the other hand, the provision of data is optional for commercial, promotional and marketing purposes referred to in point 3 of the purposes.
In case of refusal to communicate the personal data required for the processing of the same, SERVITECNO will not be able to fulfill the contractually requested service, in the event, on the other hand, of partial refusal to communicate the requested data, SERVITECNO reserves the right to evaluate the consequences of such behaviour, undertaking to promptly notify in the event that such refusal does not allow to fulfill the contractually requested service (e.g. making it impossible to provide the requested services or the requested maintenance).
In case of refusal to give your consent to the processing of data, it will prevent SERVITECNO from fulfilling the provisions of the purposes referred to in point three of the same.
The data will not be communicated or sent to third parties residing in non-EC countries without your prior consent and will not be disseminated either.
3. Categories of subjects to whom the data may be communicated
The personal data provided may be communicated to recipients, appointed pursuant to art. 28 of EU Reg. 2016/679, who will process the data as managers and/or as natural persons acting under the authority of the Data Controller and the Manager, in order to comply with contracts or related purposes, or will play the qualification of co-controller pursuant to Article 26 of the aforementioned Regulation.
Specifically, the data may be communicated to recipients belonging to the following categories:
- Entities that provide services for the management of the SERVITECNO information system;
- Competent authorities for fulfillment of legal obligations and/or provisions of public bodies, upon request;
- In the case of administrative and accounting purposes, the data collected may be communicated to SERVITECNO consultants for accounting and administrative compliance and, furthermore, the data may possibly be transmitted to commercial information companies for the assessment of solvency and payment habits and/or entities for debt collection purposes.
- For reasons exclusively related to the performance of the requested service, it is possible that your data will be communicated to other subjects who collaborate with SERVITECNO to fulfill the requested services.
The subjects belonging to the aforementioned categories perform the function of data processing manager, or operate in total autonomy as separate data controllers.
The updated list of managers and/or joint controllers to whom your data may be communicated, always for the best performance of the requested service, is kept at the SERVITECNO headquarters and may be requested by you in the following ways: by email to marketing@servitecno .it.
4. Data retention
The tax accounting data and data relating to the management of the existing contract will be kept in accordance with the provisions of the law, all other data will be kept for a time not exceeding the achievement of the purposes for which the personal data are processed, unless otherwise provided for by law.
The data collected for commercial purposes will be kept for a time not exceeding the achievement of the purposes for which they were collected and in any case no later than having received the cancellation request.
5. Rights of the interested party
In relation to the envisaged treatment, you have the right to ask the Data Controller for access to your personal data and the rectification or cancellation of the same or the limitation of the treatment that concerns you or to oppose their treatment, in particular the interested party , in relation to the personal data covered by this information, has the right to exercise the rights provided for by the EU Regulation listed below:
- right of access of the data subject [art. 15 of the EU Regulation];
- right to rectification of your Personal Data [art. 16 of the EU Regulation];
- right to have your Personal Data canceled without unjustified delay (“right to be forgotten”) [art. 17 of the EU Regulation];
- right to limit the processing of your Personal Data in the cases provided for by art. 18 of the EU Regulation, including in the case of unlawful processing or contestation of the accuracy of Personal Data by the interested party [art. 18 of the EU Regulation];
- right to data portability [art. 20 of the EU Regulation], the interested party may request their Personal Data in a structured format in order to transmit them to another holder, in the cases provided for by the same article;
- right to object to the processing of your Personal Data [art. 21 of the EU Regulation];
- right not to be subjected to automated decision-making processes, [art. 22 of the EU Regulation].
With reference to the purposes indicated above, the interested party has the right to proceed, at any time, with the revocation of consent to the processing of their data by writing to ServiTecno, Milan Via F. Koristka, 10, or by sending an email to the address: marketing @servitecno.it.
Pursuant to art. 7 of the EU Regulation, the withdrawal of consent does not affect the lawfulness of the treatment based on the consent given before the revocation.
Right to lodge a complaint:

Direct marketing purposes with the sending of commercial/promotional communications, advertising material relating to offers of services/products, via automated contact methods (such as e-mail, SMS or MMS) and traditional methods (such as telephone calls with an operator) on the Company's products/services , reporting of company events, detection of the degree of customer satisfaction, market surveys and statistical analyses.

– management of collections and payments,
– sending e-mails or other communications of a commercial nature,
– maintenance and management of the Company's information system, websites and database.

The Data may be processed by employees and collaborators of the Company responsible for pursuing the purposes indicated above, who have been expressly authorized for processing and who have received adequate operating instructions.
TRANSFER OF PERSONAL DATA TO COUNTRIES NOT BELONGING TO THE EUROPEAN UNION
“The data may be transferred to subjects established outside the European Union (EU) or the European Economic Area (EEA), in particular to the United States, a country deemed adequate by the European Commission within the limits of the “EU-US Data Protection Framework” of 10 July 2023. Where these entities are located in a country without an adequacy decision, the standard contractual clauses (SCC) referred to in the art. 46 co. 2 lett. c) of the GDPR, of which you can obtain a copy by contacting the Company at the contact points indicated above".
RIGHTS OF THE INTERESTED PARTY - COMPLAINT TO THE SUPERVISORY AUTHORITY
By contacting the Owner via e-mail at etieghi@servitecno.it, the interested party may ask the Company for access to the Data concerning him, their cancellation, the rectification of inaccurate Data, the integration of incomplete Data, the deletion of Data, the limitation of processing in the cases provided for by the art. 18 GDPR, as well as object, for reasons related to your particular situation, to the processing carried out for the legitimate interest of the owner.
Furthermore, in the event that the processing is based on the contract and is carried out with automated tools, the interested party has the right to receive the Data in a structured, commonly used and machine-readable format, as well as, if technically feasible, to transmit them to another owner without impediments.
The interested party has the right to lodge a complaint with the competent Supervisory Authority in the Member State in which he habitually resides or works or in the State in which the alleged infringement occurred.
The interested party has the right to revoke the consent given at any time for marketing purposes and to object to the processing of Data processed for the same purposes. The possibility remains for the interested party who prefers to be contacted for the aforementioned purpose exclusively through traditional methods to express his opposition only to the receipt of communications through automated methods.
